Eheim 3535 Surface suction extractor

Does anyone have this 3535 Surface suction extractor from Eheim. It does a good job but most of the time it dosn't seem to stay. It always flaps down. Mines is almost close to the surface.

I have no idea. I was wondering if anyone out there have one and is it always working 24/7.
