Trademark infringement occurs when someone delibrately mis-uses a well known name or logo in order to promote a product.

How could anybody mistake MikeRoweSoft for the 'real' thing?
Unless, of course, he sells buggy beta-release-quality software and then charges an upgrade fee for the patches!
