Tank placement

I don't have an option of putting a new 40L on a load bearing wall. I live in a upstairs apartment which is small. I have two places, one is against a wall that devides the kitchen and living room or against a wall the divides my living room and bedroom, which has a built in closet that sticks out about nine inches from the wall into the living room. Will either wall work?

still not heavy enough to worry about when you get into the 100+ gallons and the tanks weight more then 1000 pounds then its thinking time
