don't feel singled out, I get the same/similar BS responses. I write a substantial email, ask a couple questions, get a sentence fragment as a response.

I'm just as baffled. I don't understand how he thinks short-cutting time after time is going to save money. If he just did it right the first time (or even the second) then there wouldn't be nearly the issue.
Are yours eating flake? Only thing I've gotten mine (and my buddy is saying the same) to eat is frozen bloodworms / brine, and cherry red shrimp.
What's even more irritating, is that this was a group order - 3 of us went in to save on shipping. He managed to screw up something for each one of us.
I dunno what I'll do if they arrive today... and they're all dead...

I know what you are talking about as far as writing many sentences and getting one or two sentence fragments in response. I emailed him again about what he was implying when he said "do you always talk like that?" and he said that I sounded like a Victorian novel because I used the words "foul and cloudy" to describe the water, and "displeased" in my email subject. He seems a little, well, rather weird to me. He said that he will be shipping me out new fish on Monday or Tuesday, which I am glad to hear but I know it's going to be cold and asked him if he'd put a heat pack or two in...no response to that...sigh.
If you haven't received a notification email from the USPS (should have received it on 11/18) then I am guessing your fish will ship out this coming Monday/Tuesday and will arrive mid week. He said out of 13 orders he filled last week (over 100 bags he says) only one other person and myself had DOA's.
My apistos didn't seem interested in eating for a couple of days. They gradually took OSI color flakes (readily eat them now) and they love freeze dried bloodworms!!! I also feed them NLS cichlid pellets (1mm sinking) that I had for my GBR's and the apistos like those too.
I woke up this morning and noticed when I was emailing Dave that my viejita CF2 female was bright yellow. I looked closer and it looked like she was laying eggs on the underside of the sponge filter in the tank. Either she was or was trying to intice the male into spawning because he didn't seem interested. She would like tilt and flash her body sideways and almost "point" to the underside of the sponge filter. I say her ovipositor extended but he wasn't hanging around her too long. That's funny to me because he was chasing her a couple of days ago and I thought they were close to breeding...who knows though. Maybe something happened after I left for work, which is where I am now.

Keep in mind, these are copy/pasted - no editing
Today:
Me:
Nothing as of today. Any ideas?
Dave:
I got lots of ideas which one you want to hear???
Me:
How about:
I want to hear you have an idea about how this is going to get resolved. When should I expect to receive the fish that are owed to me?
Dave:
Not a problem Tim—I am shipping Mon and Tues this week cause I got behind a little last week—all you need to do is pay shipping—I suggest Express as it’s cold
Me:
Bull***t Dave. I'm not paying shipping for something that isn't my fault. Do you not recall that you didn't send part of my order? You screwed up, you admitted it. You told me to expect fish this week, and I've stayed home each day around delivery time to check and see if they were going to arrive. You didn't even have the balls to tell me they weren't shipped this past week. You send them express, you pay for shipping, and for God's sake send a heat pack ... that's what killed them the last time.
I'm sure you don't remember at this point, but you owe me:
2 A. cacatuoides Triple red females
1 A cacatuoides Triple red male
It would be nice if you replaced the Apistogramma baenschi that died, but at this point I don't even care about that one.
Dave:
What is this---- You didn't even have the balls to tell me--- I’m sorry but you and I are done, you don’t talk to me like this.
Me:
I asked if I should be expecting fish in the mail.
You replied:
"from
David Soares <apistodave@bendcable.com>
to Tim <myemail@gmail.com >,
date

subject RE: availability / ordering info

You should be getting them today"
So, that means you lied to me. Because that was wednesday, and I didn't get them. I'm referring to you not telling me that they didn't get shipped this week. You didn't have the *** to tell me that. Instead, you lead me to believe that they were on the way, when in fact they weren't. I paid for fish, and I haven't gotten them. I want my fish, or I want a refund.
I don't know what this guy's deal is. He thinks I just forgot that he screwed up and wants me to pay shipping all over again? That's just freaking stupid. Then the nerve to tell me that I'm not geting what I paid for.

I think Dave tries to be sarcastic/funny in responses and his humor is a little different. I don't think he meant anything by saying "I got lots of ideas which one you want to hear???" he just wanted YOU to be more specific about what you wanted to hear. I understood what you wanted to hear, but he was being sarcastic/funny. He has done this to me too. After my last shipment arrived (all DOA's) he said something like "I understand that fish are only good pan fried" when I told him that they were all dead. I don't know if he tries to provide comic relief but I didn't think it was funny.
Sorry to hear about your situation and hopefully you will be able to get a refund. Did you pay through PayPal? I think you can get your money back if you did but I've never had to do that before so I dont' know how complicated the process is.

The issue is tries. I'm in a business transaction with this guy, it's not like we go out and have a couple beers together. I want what I paid for, and I get comic relief. Not what I was looking for.
Yeh, I paid with paypal, I'll see what actions can be taken.

I'd wait until later on this week to do anything because you may get your fish, unless you just want your money back, in which case I wouldn't blame you one bit.

Now this is cute. I had place a Paypal claim, and after a couple days of no return communication on dave's part, I escalated the claim. Paypal's automated system denied my claim instantly (seemed like a scripting error, and I've written paypal regarding it). Here's the response I got from good ol dave:

Did you learn anything —it’s important, if you learn, you wont mess up again. If you keep messing up you need to change something.

Mr. Apisto
Thank God it was not just me.
He is a very interesting fella to deal with...I really think senality is kicking in with him. We almost got into a pissing match and I just had to smile and let it go to make sure I would get my fish. I have to admit though that the fish he sent were great specimens and I guess that is the trade off. Hope all works out with you.
David
