New heater running 9 degrees over setting - is it defective?

I recently bought a Jager 25 watt for the 5 gallon I'm setting up and it's running really hot. I haven't had an aquarium in years and wondered if this is normal, or is it defective and needs to be returned? My 100 watt Aqueon is running within a half a degree of the setting.
 
I've never relied on the temperature #'s on the heater. I've always used a separate temp thermometer, and dialed in the heater based of the thermometer.
 
I have a few that vary that much. Actually reading 80 when set to 73, etc. as long as it maintains the temperature it should be fine. I never trust the settings on the heater for anything more than a guideline for adjusting up or down a degree
